1 · What these terms cover

These terms govern your use of (a) the website at zoostats.app, (b) the ZooStats macOS application, and (c) any asset pack purchases made through this site. The publisher of all of the above is Black Bao Studio (Alicante, Spain), referred to below as "we", "us", "our".

By using the site or the app you accept these terms. If you do not accept them, do not use the site or install the app. Specific terms attached to a particular asset pack (e.g. attribution requirements) are listed on that pack's detail page and override the general licence terms below in case of conflict.

2 · The free app

ZooStats for macOS is distributed free of charge. The binary is signed and notarised by Apple. The free app is provided "as is" without warranty of any kind, to the extent permitted by Spanish and EU consumer law.

3 · Asset packs & licence

"Asset packs" are digital downloads sold via this site. Each pack contains original sprite frames and sound effects produced by Black Bao Studio. The studio retains ownership of all underlying intellectual property; purchase grants you a perpetual, personal, non-exclusive, non-sublicensable licence to:

• install and use the assets within the ZooStats app;
• on up to three (3) devices that you personally own or use;
• for personal or professional non-commercial-redistribution purposes.

You may not: redistribute, resell, sublicense, repackage, or include the assets in another product; use the assets to train machine-learning models; remove or obscure copyright or attribution metadata inside the bundle. Use of the assets outside the ZooStats app requires written permission.

4 · Payment, taxes, delivery

Payments for asset packs are processed by Polar Software, Inc., who acts as our merchant of record within the EU (and elsewhere). Polar collects and remits VAT where applicable; the price shown at checkout includes any tax due. The contract of sale is between you and Polar; we receive the proceeds net of fees and tax.

Delivery is digital: a download link is emailed to you immediately upon successful payment. If the email does not arrive within 15 minutes, check spam folders, then write to contact@zoostats.app.

5 · Right of withdrawal & refunds

EU consumers have a 14-day right of withdrawal under Directive 2011/83/EU. By starting the download you expressly waive this right with respect to the downloaded file (Art. 16(m)). Goodwill refunds are available for defective files, accidental purchases, and other clear errors. Full conditions: /refunds.

6 · Acceptable use of the site

Do not (a) attempt to overwhelm the site with automated traffic, (b) scrape pack files for redistribution, (c) impersonate Black Bao Studio in support channels, or (d) use the site to violate applicable law. We may block clients that abuse these limits.

7 · Disclaimers

The free app reads system statistics best-effort. We do not warrant that the readings are accurate for any particular use case (capacity planning, billing, regulatory reporting, etc.).

Asset packs are licensed as-is. We aim for high-quality assets and respond promptly to defects, but we do not warrant fitness for any specific aesthetic preference, downstream commercial use, or third-party tooling integration outside of ZooStats.

8 · Liability

To the maximum extent permitted by law, our liability for any claim arising out of the site, the app, or an asset pack purchase is capped at the amount you paid us for that pack (or, for the free app, EUR 0). Nothing in these terms excludes liability for death, personal injury, fraud, or any other liability that cannot be excluded under EU consumer law.

9 · Governing law & venue

These terms are governed by the law of Spain. EU consumers retain the protections of their country of residence. Disputes that cannot be resolved by direct contact may be brought before the courts competent for the consumer's place of residence (for EU consumers) or the courts of Alicante, Spain (otherwise).
